By accessing or using PYXE ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

PYXE is an AI-powered memory assistant designed for founders and professionals. The Service helps you store, organize, and recall information through natural conversation with an AI that remembers your context and preferences.

Eligibility

You must be at least 18 years old to use the Service. By using PYXE, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Registration

To access certain features, you may need to create an account. You agree to:

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any downtime or service interruptions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PYXE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability for any claims shall not exceed the amount you paid us in the twelve months prior to the claim.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Indemnification

You agree to indemnify and hold harmless PYXE and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may suspend or terminate your access at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.

You may terminate your account at any time by contacting hello@pyxe.ai. Upon request, we will delete your data in accordance with our Privacy Policy.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on this page. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
